Sean Kelly founded MS Kelly and Co (the forerunner of Kelly Legal) in 2004 and heads the firm's Commercial and Property Department. A leading advisor in the property development industry, his expertise covers project planning, development, implementation and disputes. His broader business law expertise encompasses mining and rural services as well as estate and succession planning, corporate and revenue law.

Sean enjoys adding value to his clients' businesses and projects, and working with them to make a real difference. He takes a long term view, both in advising his clients and in developing relationships with them. Sean takes particular pleasure in resolving the most complex legal issues and working with clients who face challenging opportunities.

During his 32 years of legal experience, Sean has been involved in many important projects and cases. Some of Sean's experience includes:

Sean is well regarded in the community. He is a Fellow of the Urban Development Institute of Australia (UDIA), a member of the St Vincent de Paul Society and he is honorary solicitor for the Mackay Branch of Alzheimer's Association. He has held positions on the Queensland Law Society Revenue Law Committee and as President of the Mackay Whitsunday UDIA.

He is also a keen supporter and sponsor of various local rugby league teams and is a director of the Mackay Cutters Rugby League club. As a younger man Sean represented Mackay and North Queensland in a long rugby league career.

Sean holds a Bachelor of Laws degree and Masters degrees in Business Administration and Taxation Law.

Paul Kelly is a Director at Kelly Legal and heads the firm’s Business Services and Estate Planning Department.  Paul’s depth and breadth of business expertise encompasses business set ups, sales and acquisitions, franchising, commercial property leasing, as well as more general legal advice for business and industry.

Paul has valuable experience providing legal advice, service and solutions to property developers and works in conjunction with Sean Kelly’s Commercial and Property team to provide services to the property development sector. Paul also assists clients in the areas of estate planning and business succession planning.

Paul specifically focuses his practice of law on achieving the best outcome for his clients. He actively works through strategies with clients and where costly legal disputes can be avoided and assists clients to get to the real issues of a problem and to find strategies that will achieve commercially sound outcomes.

As a member of the Kelly Legal Rural Law Team Paul has experience in a wide range of farm transactions including sales and leasing as well as experience in providing advice to farming business owners in business succession planning and personal estate planning.

Admitted as a legal practitioner in 2009, he had previously operated a local business within the insurance industry, which involved the investigation and assessment of insurance claims for damage or compensation for farm machinery breakdowns, storm damage claims to farm property and crop losses.

With strong links to the local business community Paul offers a sound commercial approach to problem solving and formulating legal strategies.

Paul is a local, born and bred in Mackay. His clients find him both approachable and accessible – key characteristics in any trusted business advisor.  Paul enjoys attending the Mackay Chamber of Commerce functions and is a member of both the Queensland Law Society and the Australian Institute of Company Directors.

Richard Callaghan is a Director at Kelly Legal and is Department Head of the firm’s Personal Litigation Department which incorporates family law services together with compensation claim services.   Richard has more than 30 years experience in private practice and prior to that worked within the Magistrates Court at various locations throughout Queensland. 

ACCRichard advises family law clients on the full range of matters including property division, children’s matters, divorce, de facto relationships and financial agreements. Richard has been a Family Law Accredited Specialist (Mackay office) since 1991 and believes in assisting his clients to achieve a fair solution as quickly as possible. He is approachable, reassuring and understanding of his clients concerns.

Richard has lived and worked in Babinda, Mackay, Brisbane, Barcaldine and Cairns, but has called Mackay home since 1970.  He is a member of the Mackay District Law Association and the Australian Family Law Association.  In his leisure time, he enjoys reading, social golf, spending time with his family and some exercise.

Elspeth Ledwy is a Senior Associate at Kelly Legal who specialises in Personal Litigation.  Her particular expertise is in the Additional Services area of that department. 

Elspeth practices on the basis that to best serve her clients it is important to be approachable and understanding. Her practice requires her to deal with very delicate, personal issues, and her clients appreciate her discretion.

Elspeth works hard to ensure she strikes a balance between being a mother of two young children, while also being available for her client’s who often need her reassurance or explanations during what would otherwise be an emotionally draining journey.

After studying and working away for 7 years after completing school, Elspeth returned to Mackay, the place she calls home.

Elspeth has been with Kelly Legal since 2007, and before joining Kelly Legal, completed her articles in Townsville and worked for four years at another Mackay firm. She holds Bachelor of Economics and Laws degrees in addition to her Master of Laws (QUT, 2007).  Elspeth is a member of the Queensland Law Society, the Mackay District Law Association, the Mackay Regional Community Legal Centre, and Mackay Women in Business.

Jane Young (nee Deguara) is a Senior Associate at Kelly Legal, practising in our Commercial Litigation Department.

Jane has experience in a range of commercial and other disputes, including property disputes, building and construction disputes, trade practices and consumer law disputes, debt recovery, corporate and personal insolvency matters and enforcement proceedings.  She has a particular interest in planning and environment matters and has been heavily involved in representing clients in the Planning and Environment Court. 

Jane is dedicated to achieving the best outcomes for her clients, whether by court proceedings or appropriate negotiations.  Jane’s clients appreciate her friendly approach, dedication and professionalism she brings to the conduct of their files.

Jane completed a Bachelor of Laws (Honours) and Bachelor of Arts at the University of Queensland in 2009.  Jane is a Mackay local and, whilst studying, worked as a summer clerk at Kelly Legal.  Jane joined Kelly Legal full time in 2010 and was admitted in 2011. 

Jane is the current President of the Mackay District Law Association and is a member of the Queensland Law Society and Queensland Environmental Law Association.

Kirsten Beck has more than 13 years' experience working in different capacities within the legal industry – since 2014 as a solicitor.  Kirsten works across many facets of the profession:  from succession and employment law right through to property, commercial, and corporate law.  She knows it takes a tailored, professional approach to meet the needs of those who live, work and do business in local regional communities.

She started her professional journey with an accounting cadetship with an accounting practice in Mackay, however it was the law that appealed to her and became her career focus.

In 2005 Kirsten joined the Kelly Legal team as a legal assistant for Sean Kelly, the founder of the practice and then sole practitioner with up to 40 staff.  She became a law clerk in 2008, and in 2013 she was conferred a Bachelor of Laws by Queensland University of Technology and became a trainee solicitor.  A year later, she was admitted as a solicitor.

A fourth-generation local, Kirsten grew up on a cane farm near Calen, in the region's north. Her husband, also a local, grew up in mining communities in the region's hinterland – so she has a well-rounded coal-to-cane understanding of what makes this region tick.

These days, Kirsten is a wife and mum, and a self-confessed armchair sports fanatic. She loves to bake (with varying levels of success) and to her, family is everything.

It's that which underpins Kirsten's personal approach and her commitment to achieving the best possible outcome for her clients.

Her direct and honest manner is appreciated by clients and the Kelly Legal team. She believes in providing targeted legal solutions, not just stock standard responses, and in taking the time to understand clients’ legal needs.

Kirsten is a legal practitioner admitted to the Supreme Court of Queensland and the High Court of Australia.  She is a member of the Queensland Law Society, and has served on the committee of the Mackay District Law Association.

Patrick Kelly is a solicitor in the firm’s Commercial Litigation and Property department. He has also worked within the firm’s Business Services and Estate Planning departments.

This broad scope of work has provided Patrick with experience and exposure to legal matters, placing him in a strong position to advise Kelly Legal’s clients as a qualified lawyer. Patrick enjoys applying his legal knowledge in isolating the main issue in each client’s matter to find the best solution to suit their situation.

Patrick worked with the Kelly Legal team during university holidays while studying a Bachelor of Laws at James Cook University in Townsville and then completed his Graduate Diploma in Legal Practice at the Australian National University while working as a trainee solicitor with the firm. Patrick has continued with the firm following his admission as a qualified legal practitioner. Patrick is a Mackay local and is an active member of the Mackay Brothers Rugby League Club.
