Sean Kelly founded MS Kelly and Co (the forerunner of Kelly Legal) in 2004 and heads the firm's Commercial and Property Department. A leading advisor in the property development industry, his expertise covers project planning, development, implementation and disputes. His broader business law expertise encompasses mining and rural services as well as estate and succession planning, corporate and revenue law.

Sean enjoys adding value to his clients' businesses and projects, and working with them to make a real difference. He takes a long term view, both in advising his clients and in developing relationships with them. Sean takes particular pleasure in resolving the most complex legal issues and working with clients who face challenging opportunities.

During his 32 years of legal experience, Sean has been involved in many important projects and cases. Some of Sean's experience includes:

Sean is well regarded in the community. He is a Fellow of the Urban Development Institute of Australia (UDIA), a member of the St Vincent de Paul Society and he is honorary solicitor for the Mackay Branch of Alzheimer's Association. He has held positions on the Queensland Law Society Revenue Law Committee and as President of the Mackay Whitsunday UDIA.

He is also a keen supporter and sponsor of various local rugby league teams and is a director of the Mackay Cutters Rugby League club. As a younger man Sean represented Mackay and North Queensland in a long rugby league career.

Sean holds a Bachelor of Laws degree and Masters degrees in Business Administration and Taxation Law.

Paul Kelly is a Director at Kelly Legal and heads the firm’s Business Services and Estate Planning Department.  Paul’s depth and breadth of business expertise encompasses business set ups, sales and acquisitions, franchising, commercial property leasing, as well as more general legal advice for business and industry.

Paul has valuable experience providing legal advice, service and solutions to property developers and works in conjunction with Sean Kelly’s Commercial and Property team to provide services to the property development sector. Paul also assists clients in the areas of estate planning and business succession planning.

Paul specifically focuses his practice of law on achieving the best outcome for his clients. He actively works through strategies with clients and where costly legal disputes can be avoided and assists clients to get to the real issues of a problem and to find strategies that will achieve commercially sound outcomes.

As a member of the Kelly Legal Rural Law Team Paul has experience in a wide range of farm transactions including sales and leasing as well as experience in providing advice to farming business owners in business succession planning and personal estate planning.

Admitted as a legal practitioner in 2009, he had previously operated a local business within the insurance industry, which involved the investigation and assessment of insurance claims for damage or compensation for farm machinery breakdowns, storm damage claims to farm property and crop losses.

With strong links to the local business community Paul offers a sound commercial approach to problem solving and formulating legal strategies.

Paul is a local, born and bred in Mackay. His clients find him both approachable and accessible – key characteristics in any trusted business advisor.  Paul enjoys attending the Mackay Chamber of Commerce functions and is a member of both the Queensland Law Society and the Australian Institute of Company Directors.

Richard Callaghan is a Director at Kelly Legal and is Department Head of the firm’s Personal Litigation Department which incorporates family law services together with compensation claim services.   Richard has more than 30 years experience in private practice and prior to that worked within the Magistrates Court at various locations throughout Queensland. 

ACCRichard advises family law clients on the full range of matters including property division, children’s matters, divorce, de facto relationships and financial agreements. Richard has been a Family Law Accredited Specialist (Mackay office) since 1991 and believes in assisting his clients to achieve a fair solution as quickly as possible. He is approachable, reassuring and understanding of his clients concerns.

Richard has lived and worked in Babinda, Mackay, Brisbane, Barcaldine and Cairns, but has called Mackay home since 1970.  He is a member of the Mackay District Law Association and the Australian Family Law Association.  In his leisure time, he enjoys reading, social golf, spending time with his family and some exercise.

Patrick Kelly

Patrick commenced with Kelly Legal in 2013 and has recently moved into the role of Partner heading up Kelly Legal’s growing Brisbane office.

Patrick studied his Bachelor of Laws at James Cook University and went on to complete his practical legal training at Kelly Legal through Australian National University. Patrick was admitted in 2014 and has since obtained a Graduate Certificate in Insolvency and Restructuring from Queensland University of Technology.

Patrick specialises in Commercial Litigation, while also actively working in the areas of Building and Construction and Planning and Environment Law. Patrick utilises his specialised experience and knowledge in this field to guide clients towards the best outcome.

Like many of his colleagues, Patrick considers the friendly and inclusive culture at Kelly Legal an important feature that allows the team to work together in a hands-on manner to deliver the best results for the client.

Sport and in particular Rugby League have played a big role in Patrick’s life and he is still heavily involved in sport and enjoys staying active. Having grown up with the laid-back lifestyle of the Mackay region, Patrick and his partner were drawn to settle on the Sunshine Coast where they can enjoy being close to Brisbane city but retreat to quieter coastal beaches.

Tina has been part of the Kelly Legal family since 2010 when she first joined the firm’s Family Law team. Tina has enjoyed working in both the Mackay and Brisbane offices while also gaining experience in other Brisbane-based firms.

Tina returned to Mackay in 2019 with her family and re-joined the Kelly Legal family law team.

After completing a Bachelor of Laws with JCU and being admitted in 2007, Tina has specialised in Family Law including domestic violence. Tina also holds a Masters in Family Law.

Tina gets great satisfaction from the personal contact she has with family law clients and being able to help them through a difficult situation with empathy and understanding.

Tina finds the Kelly Legal culture to be extremely supportive and family orientated, and her colleagues have always been genuinely nice people to work alongside.

Tina is born and bred in Mackay and has enjoyed returning with her husband and five children to rediscover everything the Mackay region has to offer. You’ll find their busy family at any number of beaches having a fish and enjoying the beautiful weather.

Jane Young (nee Deguara) is a Senior Associate at Kelly Legal, practising in our Commercial Litigation Department.

Jane has experience in a range of commercial and other disputes, including property disputes, building and construction disputes, trade practices and consumer law disputes, debt recovery, corporate and personal insolvency matters and enforcement proceedings.  She has a particular interest in planning and environment matters and has been heavily involved in representing clients in the Planning and Environment Court. 

Jane is dedicated to achieving the best outcomes for her clients, whether by court proceedings or appropriate negotiations.  Jane’s clients appreciate her friendly approach, dedication and professionalism she brings to the conduct of their files.

Jane completed a Bachelor of Laws (Honours) and Bachelor of Arts at the University of Queensland in 2009.  Jane is a Mackay local and, whilst studying, worked as a summer clerk at Kelly Legal.  Jane joined Kelly Legal full time in 2010 and was admitted in 2011. 

Brooke Patterson

Brooke joined the Kelly Legal team in early 2019 after returning to her home town of Mackay with a Bachelor of Laws from James Cook University in Townsville.

Brooke worked in conveyancing within the Property Law Centre (PLC) team as she completed her practical legal training and was admitted as a Solicitor in November 2019.

Brooke leads the PLC team and assists clients through the process of buying or selling property, paying particular attention to special dates and details that make the experience as smooth as possible.

Clients work with Brooke for pre-contract advice, contract preparation, related party transfers, leases and all standard conveyancing needs.

Working with the PLC and Kelly Legal team has been a great start to Brooke’s legal career with great exposure to a variety of work and access to her colleague’s broad experience.

Brooke is approachable, supportive and dedicated to providing the best quality, value and service in her everyday practice.

When Brooke isn’t working, she enjoys spending time with family and friends or shooting off to enjoy the beautiful Whitsundays.

Jack Hickson

Jack moved to Mackay from Canberra in late 2017 to play with the Mackay Cutters Intrust Super Cup Team and started work with the team at Kelly Legal. After securing a contract with the South Logan Magpies Intrust Super Cup Team in early 2020, Jack has moved south to join the Kelly Legal Brisbane firm.

Jack works within commercial law assisting clients with commercial and rural conveyancing, litigation and transactions. He also completes property law work namely, conveyancing, property subdivisions, easements and registering of plans.

Jack is currently studying a Bachelor of Laws (Honours) and Business Administration and has a keen interest to continue specialising in commercial law practice.

The real-world experience, friendly work environment and new opportunities within the firm have been invaluable to Jack’s studies.

During his time with the Mackay Cutters Jack was actively involved in delivering programs for schools, junior clubs and the Change the Game mental health program.

Jack enjoyed his move to tropical North Queensland, particularly Mackay’s beaches and community spirit, and is now enjoying everything city life in Brisbane has to offer.
